1. Payment and Delivery of Service

• Ebn Host allows payment using a limited number of debit and credit cards. Transactions are processed by an appointed "Payment Gateway," which is a separate organization responsible for collecting your payment and forwarding it to the processing bank. The Payment Gateway handles all transactions with your bank.
• To make a purchase on ebnhost.com, you must first register. Ebn Host Limited guarantees that the price at the time of purchase will remain valid until the delivery date. This means that any price increase after your order will not affect you, and any price decrease will not result in a refund for the difference.
• Once you place your order and complete your payment, your service will be activated instantly..
• Please note that once you confirm your payment, you will not be able to cancel your order.
• All orders are delivered electronically via email. If you have any questions regarding your order, please contact us at support@ebnhost.com.
• We cannot provide any premium domains even if they appear to be available.
• Remote connections to other servers are not allowed.
• Our services are available 24 hours a day, 7 days a week, 365 days a year.
• All payments made to us, including payment gateway fees or other payment-related charges, must be borne by the customer.
• In case of any unsuccessful payment, you must contact your card-issuing bank or the bank where you maintain your account. For any other payment-related queries, please contact your bank.
• The Service Provider reserves the right to cancel services or modify the Terms of Service and User Agreement of Ebn Host Limited without prior notice to the user.

Note: We do not provide Terminal/SSH access on shared hosting for security reasons.

2. Suspension & Cancellation Policy

Possible reasons for suspension

• Overdue Payment: There are several reasons why your website may be suspended; however, the most common reason is overdue payment. An automatic email will be generated if your payment is overdue. If this is ignored, your website may be suspended due to non-payment. Suspended accounts cannot be reactivated until all outstanding bills are fully paid.
• For VPS and Dedicated Server services, if the bills are not paid and the user does not cancel the service before the renewal date, all services associated with that account will be suspended due to overdue charges.
• Malware: Any malicious or vulnerable files found in a client’s or user’s file directory will be treated as viruses or malware. For the safety of the server and other clients or users, the affected account and hosting services may be suspended. We strongly discourage the use or upload of any corrupted, vulnerable, or malicious files.
• Phishing: Phishing is a method of obtaining personal or sensitive information through deceptive emails, websites, or site content that falsely impersonates a legitimate company. Such content is designed to mislead users into revealing personally identifiable information or other confidential data.
• High Resource Usage: Your website may be suspended if the resources you are using (CPU, RAM, cores, I/O, etc.) exceed the allocated limits.
• Bulk/Spam Email: If you send or receive bulk or spam emails from your account, or engage in prohibited email marketing, your account may be suspended or terminated without prior notice. Additionally, you will be liable for any penalties or damages caused to the server due to such activities.
• Copyright Infringement: If a claim is made against copyright for the service you purchased, or a complaint is filed regarding the content of your website, your account may be suspended. In cases of serious violations, the account may be terminated. Highly restricted content, such as movie websites, is strictly prohibited.
• Adult Content: Pornographic websites, images, or any other sexually explicit content are strictly prohibited. Pornography-related advertisements that feature or promote such content are also strictly restricted.
• Betting Site: Betting websites are strictly prohibited by our company and are also highly restricted under the laws of Bangladesh. If a user operates any type of betting website, the account may be suspended or terminated at any time by Ebn Host Limited. All payments made for such accounts are non-refundable.
• Penalty Rules: If the system is misused for activities such as copyright infringement, phishing, scams, spam emails, betting sites, or any other illegal activity, the company reserves the right to impose a penalty of up to USD 200 on the customer for such misuse. All companies worldwide are subject to applicable abuse laws. In such cases, hosting providers, domain registrars, IP providers, internet service providers, and administrative authorities may be required to address the legal consequences.
• Crime/Anti-government Activity: Any user engaging in anti-government activities, spreading false or misleading information, or otherwise damaging the reputation of the country or government may have their account or hosting services suspended. Please be aware that such accounts or services may be permanently suspended.

Note: If your account has been suspended, attempting to visit your domain will display a page notifying you of the suspension.

Once you see the suspension notice, you should open a support ticket through your client area. Ebn Host Limited will inform you of the reason for the suspension. After understanding the reason, you may correct the issue and request account reinstatement.

3. Transfer Policy

• Our Transfers Team will make every effort to assist you in moving your website to our services. Transfers are provided as a courtesy service, and we do not guarantee the availability, feasibility, or the time required to complete an account transfer. Domain transfers may take up to a maximum of 7 days.
• Each hosting company is configured differently, and some hosting platforms store data in incompatible or proprietary formats, which may make it extremely difficult, or even impossible, to migrate some or all account data. In certain cases, we may be unable to assist you with transferring data from a previous host.
• The free transfer service is available for first-time users only. We always transfer cPanel-to-cPanel data. If a cPanel-to-cPanel transfer is not possible, we are unable to perform a manual transfer.
• In no event shall Ebn Host Limited be held liable for any loss of or missing data or files resulting from a transfer to or from Ebn Host Limited.
• For a domain transfer, our Transfers Team will make their best efforts; however, the process may take up to a maximum of 7 days in accordance with international regulations.
• If a client wishes to transfer a domain from one Ebn Host account to another, and the new account does not have any active products, a fee of 50 BDT will apply.
• A migration fee of 300 BDT applies when transferring a new plan or package from an existing service.
• Ebn Host is not obligated to provide the EPP code after a domain’s grace period has ended or the domain has expired.

Note: You are solely responsible for maintaining and backing up your data under all circumstances.

4. Renew Policy

A. Domain Renew

• When you renew a domain, the renewal period is added to the remaining time on the domain. Therefore, the expiration date does not change. For example, if you registered a domain on May 1st but renewed it on April 12th, the domain will be renewed from the original registration date of May 1st. You do not lose any time; the renewal simply extends the domain by the additional period.
• Most domains can be renewed at any time throughout the year; however, certain foreign or specialty domains (such as .de, .es, and .eu) may have specific renewal requirements set by their respective registries. Any special renewal requirements for these domains will be indicated in your domain renewal reminder emails, which are sent starting four weeks before the domain’s expiration date.
• You may also enable auto-renewal for most domain extensions through the web panel.
• A domain may be renewed by anyone within the deletion period, up to 25 days after its expiration.
• Ebn Host Limited will not be responsible for any domains deleted from the registry due to non-renewal.
• If a domain is not renewed on time and is subsequently deleted, Ebn Host Limited shall not be held responsible.

B. Hosting Renew

• The service is valid for one year from the date of purchase. You may renew your service at any time.
• An invoice will be automatically generated and sent to your registered email 30 days before the service expiration date.
• You will receive a notification email 30 days before the expiration date, reminding you to renew your service.
• If necessary, a representative from the Ebn Host Limited Accounts Department may contact you regarding the renewal of your package.
• You will receive an additional reminder email 10 days before the expiration date to renew your package.
• Hosting packages will be suspended starting the day after the due date. The following 7 days constitute the grace period, during which customers may renew their package. If the package is not renewed within these 7 days, it will be terminated, and all data will be permanently deleted.

Note: Late fees will be applied to any service starting three days after its expiration. To renew the service, you must pay the applicable late fee in addition to the regular renewal charges.

5. Backup Policy

• Your use of the Services is at your sole risk. Ebn Host’s backup service runs once every 7 days. This service is available only to customers who subscribe to the backup policy and will overwrite any previous backups. Only the most recent 15 days of backups are retained.
• If you operate a critical or high-value website, it is your responsibility to back up your site daily.
• Ebn Host Limited will not be responsible for any loss of files or data.
• This backup service is provided exclusively for shared hosting accounts.
• Ebn Host does not maintain backups for Dedicated, VPS, Cloud, or Reseller accounts. Ebn Host shall not be liable for any data loss due to hardware failures, server issues, or technical problems. Users are solely responsible for maintaining their own data backups.
• You agree to take full responsibility for all files and data transferred to Ebn Host servers and to maintain appropriate backups of all such files and data.
• Overdue accounts cannot be unsuspended without payment of outstanding bills. If a customer requests backup files from a suspended overdue account, a fee will apply. Ebn Host will make the backup file available upon payment.
• For hosting plans that do not include a backup policy, a backup restore charge of 500 BDT will apply if recovery is possible. Hosting plans that include a backup policy are exempt from backup restore charges.
• After the termination of a hosting plan, if backups can still be restored, a backup restore charge of 800 BDT will apply.
• If a user wishes to take a data-only backup after the hosting period has expired, a fee of 800 BDT will be charged.

6. Free Domain Service

• A free domain name will be registered for you for the first year when you order a qualifying Domain Plan.
• Only one free domain registration is allowed per account.
• Users of the first-year free domain plan cannot transfer the domain from Ebn Host Limited before using it for a minimum of 2 years.
• This offer applies only to .com domains.
• If you migrate your package from any free domain plan, you will be required to pay for the domain.
• Users are not allowed to downgrade their current plan or package. If a user chooses to downgrade, no refund of any kind will be provided by Ebn Host Limited.

7. License

Unless otherwise stated, Ebn Host Limited and/or its licensors own all intellectual property rights for the content available on www.ebnhost.com. All intellectual property rights are reserved. You may access this content from www.ebnhost.com for your personal use only, subject to the restrictions outlined in these Terms and Conditions.

You must not:

• Republish material from www.ebnhost.com.
• Sell, rent, or sub-license material from www.ebnhost.com.
• Reproduce, duplicate, or copy material from www.ebnhost.com.
• Redistribute content from www.ebnhost.com.

• Your use of or access to this Site or the Services found at this Site;
• Your violation of any third-party right, including, without limitation, any intellectual property or other proprietary right; or
• Your violation of any provision of this Agreement or any policies or agreements incorporated herein.

The indemnification obligations under this section shall survive any termination or expiration of this Agreement or your use of this Site or the Services provided herein.

10. Refund Policy

• Service must be cancelled before a refund can be processed.
• If the Service is suspended or terminated due to your misuse or any violation of government rules, you are not eligible for a refund for that account.
• If money is refunded for any package, any discounts or affiliate earnings applied at the time of purchase will be deducted.
• If a free domain plan is refunded, the domain price will be deducted.
• Your package can be terminated at any time within seven days of the refund request. You will not be able to claim any backup after termination.
• Any processing fees will be deducted from the refund.
• All refunds will be paid in Bangladeshi Taka (BDT). Ebn Host will not be responsible for any changes in the exchange rate.
• If the refunded money is not claimed by the customer, it will be added to the customer’s EBN account balance, which can be used to purchase or renew any Ebn Host product.
• Additional refund requirements may apply based on specific terms and conditions provided at the time of purchase.
• Customers are not allowed to downgrade their current plan or package. If a downgrade is requested, no refund of any kind will be provided by Ebn Host Limited.
• If a customer requests a refund within seven days of purchase, they must provide a valid reason related to hosting services. If the reason is logically acceptable, Ebn Host will process the refund within 30 days.
• According to our refund policy, a service charge of BDT 200 will be applied to all refunded customers.

Non-refundable Services

• New domain registrations, transfers, or renewals of domain names.
• Fees for recovery or reactivation of domain names, or any extra fees.
• Any fees paid to Ebn Host for providing support not related to the purchased service.
• Dedicated IP addresses.
• VPS and Dedicated server setup fees are non-refundable.
• VPS, Dedicated, and any third-party related services are not eligible for any refund.

Refund Requests

If you believe you are eligible for a refund, you can submit a ticket. You must include the following information in your request:

• Reason for requesting the refund.
• Transaction identifying information (such as support PIN, transaction number, domain name, and date of purchase).

Ebn Host authorities reserve the right to change the rules at any time for company service purposes.

11. Law

• If you use your hosting to violate any laws of Bangladesh, you will be solely responsible.
• If you attempt to cause harm to the country or its citizens by using your Domain, Hosting, or any other product of Ebn Host, you will be solely responsible.
• Ebn Host authorities may take legal action against you at any time if you attempt to damage EBN servers or any EBN products.
• If you use your Domain, Hosting, or any other product from Ebn Host, you are solely responsible for any violations of Bangladeshi or international law.
• You are solely responsible for any breach of international law through the use of your hosting or any other product.
• Ebn Host reserves the right to cancel services or increase prices for their shared hosting and free domain plans at any time.

COMPLIANCE WITH LOCAL LAWS

If any legal complaint arises against you, Ebn Host authorities shall not be held liable. These Terms and Policies are governed by the laws of Bangladesh and applicable international laws.

12. Reservation of Rights

We reserve the right to request that you remove all links, or any particular link, to our Website. You agree to immediately remove all links to our Website upon such a request. We also reserve the right to amend these Terms and Conditions and our linking policy at any time. By continuously linking to our Website, you agree to be bound by and comply with these linking Terms and Conditions.

14. Termination

Domain

Ebn Host reserves the right to terminate your access to the Services, in whole or in part, including the deletion or confiscation of all files, content, and/or domain name registrations, without prior notice, under the following circumstances:

• You fail to pay any fees owed to Ebn Host.
• Misconduct or inappropriate behavior towards Ebn Host employees may result in termination of you
• You shall be solely responsible for any misuse, abuse, or unlawful conduct involving your domain. Ebn Host reserves the right to terminate the domain in such instances.
• You violate any of the terms or conditions stated in this Agreement.
• The domain is used for any criminal, fraudulent, or otherwise unlawful purpose, whether under the laws of Bangladesh or any other applicable jurisdiction.
• If you use a domain for adult content in violation of the laws of Bangladesh, it will be terminated.
• Your domain may be terminated if your activities violate the Bangladesh Government Act, the Bangladesh ICT Act, or any applicable international law.

Hosting Package

Overdue Payment: Your website may be terminated for several reasons; however, the most common reason is overdue payment. An automatic reminder email will be sent regarding the due payment. If payment is not made, your site will be suspended, and after seven days of suspension, it will be automatically terminated. After termination, Ebn Host Limited will not be responsible for any loss of your files or data.

Malware: Malware, or malicious software, is any program or file that is harmful to a computer user. Common types of malware include viruses, worms, Trojan horses, keyloggers, and spyware. These malicious programs can perform various harmful functions such as stealing, encrypting, or deleting sensitive data, altering or hijacking core computing functions, and monitoring a user’s computer activity without permission. If any harmful malware is found on your account, it will be terminated immediately. Ebn Host will not provide any refund or data backup in such cases.

Phishing: Phishing is a method of obtaining personal information through deceptive emails, websites, or content that falsely impersonates a legitimate company to gain sensitive or personally identifiable information. Ebn Host does not tolerate any phishing or spam activity. In such cases, the Ebn Host security team will terminate your account without prior notice. No refund or data backup will be provided.

High Usage: Your website may be suspended if your CPU usage exceeds the allowed limit. If excessive CPU usage continues repeatedly, Ebn Host authorities may permanently terminate your account. In such cases, you will not be able to claim any lost data or request a refund.

High Bulk Mail or Spam Mail: If you send bulk emails from your account or engage in prohibited email marketing, your account may be suspended. Repeated violations will result in the permanent termination of your account by Ebn Host. In such cases, no refunds or data backups will be provided.

Copyright: If a copyright claim is made against the service you purchased or a complaint is filed regarding your website data, your account may be suspended. In cases of serious infringement, your account may be permanently terminated. Ebn Host will not provide any refunds or data backups in such situations.

Adult Content: Adult content is strictly prohibited. Pornographic websites, images, or any other sexually explicit material are not allowed. Pornography ads that feature or promote such content are also strictly restricted. Violation of this policy may result in the termination of your website.

Betting Sites: Ebn Host Limited does not allow the hosting of any betting or gambling websites. Betting sites are highly restricted under Bangladeshi law. If you operate a betting site using our services, your website may be terminated at any time without prior notice. Ebn Host will not provide any refunds or data backups in such cases.

Note: You will be liable to pay a substantial penalty if any damage is caused to the server due to bulk mailing or spam activities.

15. Cron Job

A cron job is a Linux command used for scheduling tasks. Cron jobs allow you to automate certain commands or scripts on your server to complete repetitive tasks automatically.

Note: It is important that you familiarize yourself with how cron jobs work. You need to have a good knowledge of Linux commands before you can use cron jobs effectively.

Shared Hosting

• You may not run a cron job more often than once every 2 hours.
• You can add a maximum of 2 cron jobs in your shared hosting account.
• If our specialized team finds extra cron jobs beyond the allowed limit, appropriate action may be taken.

VPS and Dedicated Server

• You may run cron jobs as often as you like.

16. Late Payment

• All invoices must be paid within seven (7) days of the invoice due date. Any invoice outstanding for more than seven (7) days may result in the suspension or termination of services. Access to the account will remain inactive until the due payment is received.
• If you fail to pay the fees as specified, Ebn Host may suspend or terminate your account and pursue collection of any costs incurred, including, without limitation, arbitration fees, legal fees, and reasonable attorney fees. Ebn Host will not activate new orders or packages for customers who have a negative or insufficient balance in their account.
• If payment is not made within the specified time, the service will be canceled and all hosting data will be deleted.
• Once the hosting data is deleted, the company will not retain any data, and the customer will have no claim to any deleted information.

17. Disclaimers

To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

• Limit or exclude our or your liability for death or personal injury.
• Limit or exclude our or your liability for fraud or fraudulent misrepresentation.
• Limit any of our or your liabilities in any way that is not permitted under applicable law.
• Exclude any of our or your liabilities that may not be excluded under applicable law.

By using our Services, you agree to be bound by this Agreement. If you do not agree to comply with these terms, you are not authorized to use or access our Services.

Users must not exceed the resource limits allocated to their hosting plan. Continuous usage exceeding thirty percent (30%) of the assigned resources will not be permitted. Users are strictly prohibited from sending bulk or unsolicited emails. Utilizing the Services in any manner that abuses or infringes upon the privacy or property rights of others—including, but not limited to, the transmission of unsolicited bulk email (“spamming”)—will result in suspension or termination of the account. Such actions are considered separate from, and in addition to, any applicable fees incurred as a result of the violation. The User agrees to pay a cleanup fee of fifty dollars (USD $50) per hour if any of Ebn Host’s server IP addresses are blacklisted due to spam activity originating from the User’s account.

• Using the Services in any manner that constitutes a violation of any applicable statute, law, court order, regulation, or treaty (including, but not limited to, those relating to intellectual property, communications, privacy, criminal, or international law)
• Using your hosting account primarily as a file storage or image hosting service.
• Using the Services to attempt to breach, or actually breach, the security of any computer network (including the Service itself), or to access any account, message, or file that does not belong to you.
• Use your account as a backup or storage service. All uploaded files must be directly related to your website and accessible through it. Dedicated server clients are exempt from this restriction.
• Using the Services to forge, falsify, or misrepresent headers, addresses, or other identifying information in emails or websites, or using any method to disguise the sender’s identity or location. This includes hosting proxy server applications.
• Uploading, linking to, or storing warez, cracks, serial numbers, or any other pirated or illegal software.
• Assisting in, or directly distributing, copyrighted material without proper authorization.
• Excessively using the Service in a manner that limits or restricts the bandwidth available to other users.
• Providing false, inaccurate, or incomplete contact details, including name, postal address, or telephone number.
• Using the Service to operate server programs, including but not limited to mail servers, IRC servers, game servers, FTP servers, web servers, or streaming audio/video servers.
• Using the Service for unauthorized relays through any third-party systems.
• Attempting, in any way, to interfere with or deny service to any user, host, or network on the Internet.
• Initiating a chargeback on any past or present transaction will result in account suspension until the issue is resolved. If a chargeback is issued, we reserve the right to permanently remove your account and deny any future business.
• Using the Service for “mail bombing,” which includes sending multiple messages to a specific destination with the intent to disrupt or disable the recipient and/or the system serving that recipient.
• Using the Service to add or attempt to add email addresses to any mailing list (yours or a third party’s) without the explicit and verifiable consent of the recipient(s).
• Attempting to cancel, supersede, or otherwise interfere with email communications that do not belong to you.
• Engaging in harassment in any form, whether through language, frequency, or the size of messages, either by email or through website content.
• Using the Service to engage in SYN flood attacks, defined as overburdening a recipient computer system by sending a high volume of spurious data that effectively impedes or completely disables the functionality of the recipient system(s), or engaging in any other form of denial-of-service (DoS) attack.
• Using the Service to host or distribute phishing content.
• Providing false or misleading information on your sign-up form, contract, or online application, including the use of fraudulent credit card or other payment information.
• No billing credit will be issued during any suspension period. In the event of termination of your Service under this section, Ebn Host reserves the right, at its sole discretion, to retain any or all amounts paid by you as liquidated damages for your actions.
• Security - You agree not to access or attempt to access any private areas of the Service. You must promptly notify Ebn Host upon becoming aware of any unauthorized use of your account and/or any breach or attempted breach of security within the Service.
• Intellectual Property - Ebn Host does not undertake to monitor or review messages, files, or other materials that pass through, reside on, or are accessible via the Service. Complaints regarding alleged copyright infringement should be directed to abuse@ebnhost.com.
• Such complaints must include a specific identification of the allegedly infringing material and the exact location(s) on Ebn Host’s servers where the material resides. Upon receiving a valid written notice, Ebn Host will promptly remove or block access to the allegedly infringing material and notify the person who posted it. If Ebn Host subsequently receives a counter-notification claiming that the removal or blocking was based on a mistake or misidentification, Ebn Host will forward that notice to the original complainant. Unless Ebn Host is notified of court action seeking to restrain the alleged infringement, the removed material will be restored or otherwise made accessible again.
• Liability - You agree that the use of the Service is entirely at your own risk. Except for information, products, or services expressly identified as being supplied by Ebn Host, neither Ebn Host nor any of its affiliates controls, provides, operates, or is in any way responsible for any information, products, or services accessible through the Service. Ebn Host neither endorses nor assumes responsibility for the accuracy or reliability of any third-party materials. You agree that Ebn Host shall not be liable for any loss or damage resulting from your use of, or reliance upon, such materials. You further understand and agree that you are solely responsible for any content or material you post or transmit to any website or newsgroup on the Internet—including, but not limited to, content hosted on Ebn Host servers, postings to newsgroups, or participation in online forums or chat sessions. You agree to indemnify and hold harmless Ebn Host, its employees, and its customers from and against all claims, losses, costs, liabilities, damages, or expenses arising from your postings or use of the Service.
• If you use the Service to send or receive voice communications, you acknowledge and agree that Ebn Host is not acting as a telecommunications carrier or telephone company. Ebn Host makes no representation or warranty regarding the suitability of the Service for such use. All risks related to connection quality, transmission reliability, and communication accuracy rest solely with you. Ebn Host shall have no liability whatsoever for any failure, disruption, or degradation in the quality of such voice communications.
• You agree to be held liable for any damages or service interruptions caused to Ebn Host as a result of spamming or any other violations of Section 5 of this Agreement. Such damages may include, but are not limited to, system shutdowns, retaliatory attacks, data flooding, or loss of peering arrangements. You further agree that Ebn Host reserves the right to pursue legal action against you in a court of law to recover such damages.
• You agree that under no circumstances shall Ebn Host be financially liable to you for any damages, losses, or expenses arising from the use or inability to use the Service, whether direct, indirect, incidental, or consequential.
• Warranty - Ebn Host makes no express or implied warranties, including but not limited to warranties of title, non-infringement, merchantability, or fitness for a particular purpose, regarding the Service or any software or materials made available through it — regardless of any statements you may have made to Ebn Host about your intended use. No oral advice or written information provided by Ebn Host or its employees shall create a warranty or modify the terms of this section.
• The Service and any software provided by Ebn Host are offered strictly on an “as is” and “as available” basis. Ebn Host does not warrant that the Service will be error-free or uninterrupted, nor that any defects will be corrected. Furthermore, Ebn Host does not guarantee the security, integrity, or backup of any data stored or transmitted through the Service. You are solely responsible for maintaining adequate data backups and security measures.

19. Content Liability

We shall not be held responsible for any content that appears on your website. You agree to protect, defend, and hold us harmless against all claims arising from your website. No link(s) should appear on any website that may be interpreted as libelous, obscene, criminal, or that infringes, violates, or advocates the infringement or other violation of any third-party rights.

20. Discount Policy

Category-wise membership discounts are applicable only to hosting plans, excluding Domain and Free Domain plans. These discounts apply only to new purchases and do not apply to renewals or upgrades.
